These Terms & Conditions governance your access to and use of our website (https://lavainkotelecom.com) and our international Voice termination, A2P/Enterprise SMS routing, and telecom infrastructure services (collectively, the “Services”).

By accessing our website or utilizing our Services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not access the website or use our Services.

1. Services & Scope

Lavainko Telecom provides wholesale Voice termination, CLI/Non-CLI routing, A2P SMS messaging gateways, and related telecommunications infrastructure to global carriers, service providers, and corporate clients.

  • Service Provision: All Voice and SMS services are provided according to agreed bilateral interconnect agreements, service level agreements (SLAs), and prevailing rate sheets.
  • Modifications: We reserve the right to modify, upgrade, or discontinue any aspect of our network, routing features, or website content at any time.

2. Account & Interconnection Obligations

To access certain telecom services or rate sheets, you may be required to register an account or enter into a bilateral service agreement.

  • You are responsible for maintaining the confidentiality of your account credentials and IP interconnect details.
  • You agree to provide accurate, current, and complete corporate information during onboarding.
  • You accept full responsibility for all call traffic, SMS messaging volume, and charges incurred under your account or authorized IP addresses.

3. Acceptable Use Policy (AUP)

You agree to use our Voice and SMS network strictly for lawful purposes. You must not send or transmit traffic that involves:

  • Fraudulent Traffic: Call spoofing, artificial inflation of traffic (AIT), robocalls, or Unauthorized Toll Fraud.
  • Spam & Unsolicited Messaging: Unsolicited commercial SMS messages, illegal marketing, or messaging that violates international anti-spam laws (e.g., TCPA, GDPR).
  • Malicious Content: Messages containing phishing links, malware, spyware, or illegal content.
  • Network Abuse: Actions that attempt to bypass billing, interfere with network stability, or disrupt other clients' traffic flow.

Lavainko Telecom reserves the right to immediately suspend or terminate access to any client violating this Acceptable Use Policy without prior notice.

4. Pricing, Billing & Payment Terms

  • Rate Sheets: Rates for Voice termination and SMS delivery are subject to fluctuation based on international carrier market conditions. Updated rate sheets will be provided via email or portal notifications.
  • Billing Models: Services are provided under prepaid or postpaid billing arrangements as specified in your commercial agreement.
  • Payment Terms: Payments must be settled in full without any set-offs or deductions. Unpaid balances may lead to immediate traffic suspension.

5. Network Uptime & Service Levels

While Lavainko Telecom strives for maximum network availability and optimal Answer-Seizure Ratios (ASR) through intelligent routing engines and 24/7 NOC monitoring, telecom networks rely on third-party global carriers and MNOs. We do not guarantee uninterrupted or error-free transmission across external third-party networks.

6. Intellectual Property Rights

All content on this website—including logos, branding, text, graphics, dynamic routing software descriptions, and layouts—is the exclusive intellectual property of Lavainko Telecom and is protected by international copyright and trademark laws. Unauthorized copying, distribution, or re-engineering is strictly prohibited.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Lavainko Telecom shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with:

  • The use or inability to use our Voice or SMS services.
  • Unforeseen network outages or delivery delays caused by upstream carriers.
  • Unauthorized access to or alteration of your transmissions.

8. Indemnification

You agree to indemnify, defend, and hold harmless Lavainko Telecom, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, your traffic content, or your violation of third-party rights or telecommunication regulations.

9. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with applicable laws. Any legal action or proceeding arising out of these Terms shall be settled through binding arbitration or within designated competent courts.
